About the NYS Driver Point System

What is the Driver Violation Point System and how does it work?

The Driver Violation Point System gives the New York State DMV a way to identify and take action against high risk drivers. The DMV assigns points for certain traffic violations. If you get 11 points in an 18-month period, your driver license may be suspended. 1 However, the point system is not the only way to lose your license (see Suspensions and Revocations).

How your point total is calculated
you must be convicted of the traffic violation before points are added to your driving record
your point total is calculated based on the date of the violation, not the date of the conviction
the points for violations that all occurred within the last 18 months are added to calculate your point total 2

Number of points assigned for common traffic violations

License Violation PointsVIOLATIONPOINTSSpeeding (MPH over posted limit)
1 to 10 3
11 to 20 4
21 to 30 6
31 to 40 8
Over 40 11
Reckless driving 5
Failed to stop for school bus 5
Followed too closely (tailgating) 4
Inadequate brakes (private car) 4
Inadequate Brakes (employer's vehicle) 2
Failed to yield right-of-way 3
Disobeying traffic control signal, STOP sign or YIELD sign 3
Railroad crossing violation 5
Improper passing, changing lane unsafely 3
Driving left of center, in wrong direction 3
Leaving scene of property damage incident 3
Child safety restraint violation 3
Improper cell phone use 5
Use of portable electronic device ("texting") 5
Any other moving violation 2

Points are not assigned for the following violations
any bicycle violation
any pedestrian violation
any parking violation
any violation related to unregistered, unlicensed or uninsured operation
any violation related to motor vehicle inspection, vehicle weights or dimensions or vehicle equipment other than inadequate service brakes
any violation related to a business or the sale of goods established in the Vehicle and Traffic Law or any local law
a violation related to the improper use of High Occupancy Vehicle Lanes in Suffolk County, between exits 49 and 57 of the Long Island Expressway
any other violation not resulting from the operation of a motor vehicle

Driver Responsibility Assessment

If you receive 6 or more points on your New York State driving record in 18 months, you must pay a Driver Responsibility Assessment fee.

Out-of-state convictions

If you are convicted of a traffic violation in another state or country, points are not added to your New York State driving record, unless the violation occurred in Ontario or Quebec.

New York State has a reciprocal agreement with Quebec and Ontario. Traffic violation convictions that occur in these provinces are recorded on your New York State driver record, and the convictions have the same effect and carry the same points as convictions that occur in New York State. This can affect your driver violation point total and Driver Responsibility Assessment.

Insurance Premiums

Insurance companies have their own point systems and can increase your premiums based on your driving record. Contact your insurance company for more information.

Point and Insurance Reduction Program

Taking a DMV-approved Point and Insurance Reduction Program (PIRP) course will
help to prevent you from losing your license in the event you accrued 11 or more points on your driving record
4 points are 'subtracted' for the purposes of calculating a suspension if you have 11 or more points
the tickets/points do not physically come off your driving record
save 10 percent on your automobile liability and collision insurance premiums

Learn more about the PIRP course.

Check My Points

You use the MyDMV 'My License, Permit or ID' service to check your points. You will need the ID number and document number from your most recently issued New York State
driver license,
learner permit, or
non-driver ID
If you lost your document, renewed or ordered a new one recently and have not received it in the mail yet, you will need to wait for it to arrive before you can create a MyDMV account.

Check my points through MyDMV

1If you claim that someone else committed a violation on your record, you can request a hearing. But you cannot request a DMV hearing to prove that you were not guilty of the violations.
2Once 18 months have passed from the violation date, the points for that violation no longer count toward your total. However, the points remain on your driving record as long as the conviction remains on your record and may be used by your insurance company to increase premiums.

Get a learner permit

Get a learner permit

Getting a permit is the first step to get your driver license. You can't get a permit at any driving school in Westchester . Most people apply for a Class 'D - Operator' permit. 1 You must be 16 or older and must apply in person at a DMV office. You do not need an appointment for the written test. No Westchester driving school  can give you a written test.

Here are the steps you need to take:

Step 1: Be prepared to take the written permit test

study the NYS Driver's Manual and take the practice tests so you can pass the test

class D and M permit tests are given in 14 languages: English, Albanian, Arabic, Bosnian, Chinese, French, Greek, Hebrew, Italian, Japanese, Korean, Polish, Russian and Spanish

you must get at least 14 of the 20 multiple-choice questions correct

this includes the correct answers to at least two of the four questions about road signs
if you are applying for a motorcycle permit, you must get at least three out of the five motorcycle questions correct. If you want a drivers manual, you can get that at Adrian's Driving School in Westchester

Step 2: Know what to bring to the DMV

complete this guide to make sure you have the documents and proofs of identification you need BEFORE going to the DMV

Step 3: Go to the DMVapply and pay for your permit 2
take your written test (if you fail, you can try again at no additional cost)

For quicker service, make a reservation online before visiting offices in New York City, Westchester, Nassau, Suffolk, Rockland, Onondaga or Albany Counties. See offices where this service is available.

Step 4: Wait up to 2 weeks for your permit to come in the mail
your permit will be valid for approximately 5 years (the exact expiration date depends on your date of birth and the date that you applied)
once you have your permit, you can move onto Step 5.

Step 5: Prepare for your road test
you must have supervised driving practice with your parent or call Adrian's Driving School or any other driving school in Westchester 3
you must take a pre-licensing course at Adrian's Driving School or a driver education course at your High School or Collage before you take your road test
you will need to follow all learner permit restrictions

Step 6: Take your road test
take your road test before your permit expires (you cannot renew a permit)
if you pass your test, the examiner will give you an interim license that allows you to drive
keep the interim license with your photo permit until your new license arrives in the mail (in about 2 weeks)
if you fail, start again at Step 5

Please help us improve the Driver’s Manual by answering a short online survey.

To change your junior license to a senior license, bring your junior license and the Student Certificate of Completion (MV-285) that you received from your instructor to any DMV office. You must return your certificate and junior license to receive the senior license. If you do not change your junior license to a senior license, you are subject to the restrictions for junior drivers until you are age 18, even if you carry the completion certificate with you. The local DMV office will destroy your foreign driver license after 60 days. If you plan to return to your home country and will need your foreign driver license, ask the road test examiner how to make sure that your foreign driver license is not destroyed. Still haven't found what you're looking for? See a list of all driver license and learner permit topics. 1 Definition of Resident per Section 250 (5) of the NYS Vehicle and Traffic Law: "As used in this section, the term 'resident' shall mean domiciliary, that is, one who lives in this state with the intention of making it a fixed and permanent abode. It shall be presumptive evidence that a person who maintains a place of abode in this state for a period of at least ninety days is a resident of this state." To live in a house, a home, an apartment, a room or other similar place in NYS for 90 days is considered "presumptive evidence" that you are a resident of New York State. A police officer can use this as evidence to issue a traffic ticket if you drive in New York State without a New York State driver license or vehicle registration. A judge considers the law and the evidence of your intent and decides if you are a resident of New York State. If you pay taxes or your children attend school in another state, a judge considers these facts to decide if your intent is to make NYS a "fixed and permanent" residence. According to this law, students from other states or from other nations who attend school in New York State are usually not considered residents of NYS. DMV does not decide if you are a resident of New York State, if you must get a NYS driver license, or if you must register your vehicle in New York State.

Reviews from our students!

From Patricka!
My wife just passed her road test last week thanks to Adrian. I tried my best to teach my wife how to drive, but I had a hard time doing so. This is when I found Adrian's website. I read all his reviews and it turns out that all the reviews were right! Adrian is the best driving instructor out there. Even after the 2nd lesson I can see a HUGE improvement on my wife's driving skills. By the time my wife had her last lesson before the road test I was 100% sure she would pass becuase Adrian prepared her that well for it! Thanks Adrian for your help and guidance for teaching my wife how to drive. Patrickâ
From Crystal!
Adrian's Driving School was a great experience. I signed up for the 5-lesson package and passed the road test. Adrian was a professional and honest instructor throughout the course of my lessons. I'd definitely recommend him to family and friends.
From Marlyn!
When I decided that I was going to move to Dutchess County, I knew the time had finally come to get a drivers license. I am a city girl and I never needed a DL before. I found Adrian because I was living in Tarrytown at the time and he was very close. I read the reviews on his website and I thought I'd see if they were legit. He is by far the best instructor anyone could ask for. He is very patient, honest, friendly, tolerant and always with a very calm demeanor. He really wants to see you succeed and become a good driver. I think there are a lot of jerks on the road because they were not taught by Adrian. I have had lessons with him where I think any other instructor would have yelled at me. Not Adrian, even when he sees you being hard on yourself, he will reassure you that you're not doing so bad. And if you are, he'll find a way to say it where it doesn't sound so bad. :) I could not have passed my road test without Adrian's help. I highly recommend him to everyone!
From Sandy!

You can practice driving with him as long as you want, but be sure he has a spot opened for you. He is fully booked! So try to call him now and set for an appointment for your driving lessons. I assure you you will be one of the professional drivers in the country! Ready!!! Go!! Sandy
From Sourabh!
Hi, I come from India and have taken only two lessons with Adrian and got my Driving Permit today after a successful road test. I can only have praises for the driving school. Adrian (instructor) is very polite, attentive and gives you a instant feedback of your mistakes. He is patient with students to help them overcome the initial driving fear and gain confidence. I highly recomend Adrian's for the following reasons: 1. Personalized instructions 2. Quality of the Car 3. Tips for parallel parking, 3-point turn etc are amazing. It seems so easy after learning from him. 4. Very timely. 5. Adrians experience with students and inspectors makes him very capable of telling you the right thing at the right time. 6. Cost of an hour lesson with Adrian is un-believeable considering the amount of tips you get from him and the practice you can do. So Fasten your seat belts, check the mirrors, start the car and step on the gas (dont forget the driving gear)... Adrians.. You Rock!! Safe Driving!!! Thanks Adrian for everything. --Sourabh
From Alex F!
The best driving school period! I looked at several Westchester driving schools and the one that came up with the best reviews won. Picking Adrian's Driving School was the best decision that I have ever made. Adrian is not only a patient driving instructor but is always professional not matter the situation. His clear and precise instructions made learning easy and enjoyable. I felt that I was driving around with a friend instead of an instructor. I did take lessons with other schools that were unprofessional and unrealistic. Adrian was honest and told me how many lessons I would need to learn to drive correctly. Any driving school can teach you enough to help you pass the road test, but Adrian's Driving School is THE one that teaches you how to drive correctly in real life situations. I was able to pass my road test with no major issues. I was so impressed with their instruction that my sister will be taking lessons from Adrian very soon. If you only like to dealing with the best of the best then Adrian's Driving School is for you. Thanks for all your help Adrian from Alex F€Ž

Review from our students

Dear Andrian's driving school: I am writing to express our gratitude to your service taking us to the driving test this morning. Michael who is the instructor did a wonderful job to ensure the success of test. My husband Nan took the test and he passed it. Michael is very professional in terms of driving instructions and making effort to make the whole process as smooth as possible. We have met several other instructors from other schools too, but we both think Michael is definitely the most professional instructor from our experience. So thanks again! Yours sincerely, Nan and Jingjing

Young Couple in Westchester

My wife and I came to the US a few years ago and soon learned we were each going to need a driver's license. We had no driver's license from our country. We learned about Adrian and booked lessons with him.

We were surprised by how quickly and easily we learned how to drive, parallel park, spot traffic situations and be defensive drivers in general. To give you an example, when you're at a stop sign about to enter a priority road, always double check that a driver entering the intersection from your left who signals a right turn is actually going to turn before entering the intersection, because people can change their minds and give you a nasty surprise. (I changed my mind once in the role of the guy who signals.)

We both took our driver's license from the first try. We drove Adrian's car during the exam.

We later referred a friend we knew to Adrian. The friend decided to go with another driving school instead. He was given a date for the exam only to find out, after waiting for the exam day for a month and a half, that no exam had been scheduled for him, and that it had all been a misunderstanding. He eventually scheduled an exam, but failed it. When he later chose Adrian's driving school as we had suggested, he passed the test from the first try.

Adrian is patient, courteous, on time, and very knowledgeable. He is passionate about his job, as you'll notice with the first lesson. He goes beyond the standard due to his study of traffic laws in school.

Both my wife and I strongly recommend Adrian's driving school for a smooth path to getting your driver's license as a safe and dependable driver.

Thanks, Adrian!
